  • Stormwater and drainpipes must be free-flowing and functional. If blockages stem from wear and tear – such as age, tree roots, or weather damage – the property manager or owner is responsible for clearing and repairing them.

  • Gutter cleaning and maintenance fall on the landlord’s side if the tenant hasn’t caused the blockage – for instance, natural build-up of leaves or debris.

2. What Tenants Are Expected to Do

  • Tenants must promptly report issues like blocked drains or overflowing gutters.

  • If they’ve caused the blockage (for example, flushing inappropriate items down the drain or filling gutters with debris), they may be required to pay for the clearing or repairs.

  • That said, tenants should never withhold rent due to maintenance issues; it’s a breach of the tenancy agreement.

3. When Drain or Gutter Issues Become “Emergency Repairs”

  • Major plumbing faults, such as serious leaks or blockages that affect essential services or pose safety risks, may qualify as emergency repairs under the Act.

  • Examples include burst water services or severe drainage failure likely to cause property damage or health concerns.

  • In these cases, landlords must act swiftly. If contact can’t be made, a tenant may arrange repairs (up to the value of four weeks’ rent) and seek reimbursement within seven days.
